The omission of due diligence, negligence, or lack of precaution that leads to criminal and civil liability. To qualify it, it is essential that the act that determines it is not malicious, and that the agent, when carrying it out, does not intend to cause any harm. In civil law, imprudence gives rise to compensation for damages, which includes both lost profits, i.e., what has not been earned as a result of imprudence, and the emergent damage or harm caused.
